TERMS OF SERIVCE
Trusty Haul (Operating Brand) — TRUST TARILERS LTD (Legal Entity)
Effective Date: 20-05-2023
Last Updated: 20-12-2025
1) Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of TrustyHaul.com (the “Website”) and any purchase or service arranged through it.
By browsing the Website, submitting an inquiry, placing an order, or otherwise using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms are written to reflect the practical realities of heavy-equipment and freight-based transactions.
2) Who We Are
Trusty Haul is the U.S. operating brand of:
TRUST TARILERS LTD (United Kingdom private limited company; incorporated 16 April 2004)
Registered Address: Houndhill Park, Bolton Road, Wath-Upon-Dearne, Rotherham, S63 7LG, England
U.S. Operations (Head Office / Warehouse):
114 Whalen Loop Rd, Woodland, WA 98674, United States
In these Terms, “Trusty Haul,” “we,” “us,” or “our” refers to Trusty Haul operating under TRUST TARILERS LTD.
3) Eligibility and Use of the Website
You agree that:
- you are legally able to enter into a contract, and
- any information you provide to us (including contact, delivery, and payment-related details) is accurate and current.
You may use the Website for legitimate browsing, inquiries, and purchases. You may not use it for fraudulent, deceptive, abusive, or unlawful purposes.
4) Product Listings, Descriptions, and Availability
A. Listings Are Informational Until Confirmed
Product listings are provided to describe the type of unit available. Because heavy equipment inventory can change and logistics are variable, listings are not treated as automatic guarantees of immediate availability or dispatch.
B. Availability
Most units are available from our operational inventory. If a unit is temporarily unavailable, we may source an equivalent unit through vetted partner companies. If partner sourcing is required, we will inform you before dispatch and confirm specifications and condition expectations during order confirmation.
C. Photography and Representation
Images are used to illustrate the product type or unit style. The exact specification and condition applicable to your order is confirmed during the order confirmation process.
5) Order Process and Confirmation
A. Orders Are Reviewed
Submitting an order through the Website does not automatically mean the unit has been dispatched. Each order is reviewed to confirm:
- availability and allocation,
- delivery feasibility and scheduling requirements,
- final shipping cost agreement, and
- customer contact confirmation.
B. Order Confirmation
An order is considered confirmed only after we complete operational review and you approve any required shipping quote and scheduling details (where applicable).
6) Pricing and Errors
A. Product Price vs Delivery Cost
Prices shown on product pages generally reflect the unit price. Because these are freight-based deliveries, shipping cost is calculated per order and confirmed with the customer prior to dispatch.
B. Pricing Corrections
If a clear pricing error occurs (for example, a technical or publishing mistake), we may correct it before confirming the order. If correction is required, you will be notified and you may proceed under the corrected terms or cancel.
7) Shipping and Delivery
Shipping is not fixed-price. Freight delivery is calculated per order based on practical factors such as distance, unit dimensions, route access, and scheduling.
Estimated delivery timelines are provided as ranges and are not guarantees.
Full shipping details are set out in our Shipping Policy, which forms part of these Terms.
8) Payments
We accept the payment methods made available at checkout or communicated through invoice where applicable.
Depending on payment method:
- card payments may be authorized and captured after confirmation, and/or
- bank transfers may be required for higher-value purchases.
We may request reasonable verification for fraud prevention, especially for high-value transactions.
Full payment handling is described in our Payment Policy, which forms part of these Terms.
9) Sales Tax
Sales tax may be charged when required by applicable law and may depend on delivery destination and tax nexus obligations. Tax treatment and any exemption documentation must be addressed prior to dispatch where applicable.
Full details are described in our Sales Tax Policy, which forms part of these Terms.
10) Cancellations, Returns, and Refunds
A. Before Dispatch
Orders cancelled before dispatch are generally refundable, subject to reasonable deductions where costs have already been incurred (as defined in the Return & Refund Policy).
B. After Dispatch
Once dispatch occurs, freight and transport costs are typically non-refundable. Any return after dispatch is assessed case-by-case based on feasibility and unit condition.
C. 30-Day Return Request Window
Customers may request a return within 30 days of delivery for eligible products, subject to approval and conditions outlined in the Return & Refund Policy.
D. 48-Hour Damage Reporting
Visible transport-related damage must be reported within 48 hours of delivery with supporting documentation. This is a damage-reporting requirement and does not replace the 30-day return request window.
Full terms are in our Return & Refund Policy, which forms part of these Terms.
11) Warranty
Warranty coverage depends on whether the unit is new or used and whether manufacturer warranty applies. Any Trusty Haul limited warranty, if offered for a specific unit, will be stated on the listing, invoice, or confirmation documents.
Warranty terms and exclusions are explained in our Warranty Policy, which forms part of these Terms.
12) Customer Responsibilities
You agree to:
- provide accurate delivery and contact information,
- disclose known delivery access restrictions in advance,
- be available (or authorize a representative) to receive delivery,
- inspect the unit at delivery and report issues promptly, and
- use the unit safely and according to any applicable guidelines and legal requirements.
If delivery fails due to incorrect information or undisclosed restrictions, rescheduling or return transport costs may apply.
13) Intellectual Property
Website content (text, design, original images, logos, and branding) is owned by TRUST TARILERS LTD or used under license. You may not copy, scrape, republish, or commercially use site content without written permission.
Details are provided in our Intellectual Property Rights Policy, which forms part of these Terms.
14) Prohibited Conduct
You may not:
- misuse the Website or attempt unauthorized access,
- submit false or misleading information,
- interfere with Website security or operation,
- use the Website to impersonate others or conduct fraud,
- attempt to harvest data or scrape product listings at scale.
We may restrict access to the Website where misuse is suspected.
15) Third-Party Links and Services
The Website may reference third-party services (such as payment processors, mapping tools, or analytics providers). We do not control third-party websites and are not responsible for their content or practices.
16) Disclaimers (Realistic, Freight-Based Context)
To the extent permitted by law:
- the Website is provided on an “as available” basis,
- delivery timelines are estimates and depend on real-world conditions,
- product representation is confirmed during order confirmation, and
- no statement on the Website should be treated as a guarantee unless explicitly confirmed in writing.
Nothing in these Terms limits rights that cannot be limited under applicable law.
17) Limitation of Liability
To the extent permitted by law, Trusty Haul’s liability is limited to direct losses and will not include indirect or consequential losses such as business interruption, lost profits, or downtime costs.
Where permitted, total liability relating to a purchase is limited to the amount paid for the product (excluding freight), unless otherwise required by law.
This limitation is important in freight-based transactions where consequential claims can be disproportionate to the order value.
18) Indemnity
If you misuse the Website, provide false information, or violate these Terms in a way that causes harm or legal exposure, you agree to indemnify and hold Trusty Haul harmless from resulting claims, damages, and reasonable costs.
19) Governing Law and Dispute Handling
Because our U.S. operations are based in Washington State and most transactions involve U.S. delivery coordination, these Terms are intended to be governed by the laws of the State of Washington, without regard to conflict of law rules.
If a dispute arises, we encourage resolution through direct communication first. If informal resolution fails, disputes may be brought in the appropriate courts located in Washington, unless mandatory consumer protection laws in your jurisdiction require otherwise.
(If you want arbitration language, tell me—some merchants prefer it, but it must be done carefully to avoid looking aggressive or unfair.)
20) Changes to These Terms
We may update these Terms to reflect operational changes or legal requirements. The “Last Updated” date shows the latest revision. Continued use of the Website after updates means you accept the revised Terms.
